NYU Arrests, Disciplinary Hearings & Title IX Misconduct Investigations

There are very few colleges or universities in New York City or anywhere in the State of New York that NYU plays second fiddle to. New York University boasts an outstanding undergraduate college, the Stern School of Business, a top rated medical school and other graduate programs. Maybe that is why an arrest, disciplinary hearing or Title IX investigation for an undergraduate or graduate student should not be taken lightly. In fact, it should be handled with the utmost care and attention. One slip up, mistake, or miscalculation can be the difference between a criminal record, end of your collegiate studies or a life experience that you can walk away from unscathed or damaged in a most nominal way as possible. You always have rights, and your attorney will advocate for you as best as he or she can, but school security, a Title IX coordinator, detective or police officer with the New York City Police Department (NYPD), or a prosecutor with the Manhattan District Attorney’s Office is more concerned about the safety of the community and your fellow students than your criminal record, suspension or expulsion.

NYU Criminal Investigations and Arrests

Yes, NYU’s Manhattan campus is an amazing facility that draws students not just from New York, but from countless foreign countries. However, it is not only the Manhattan campus where trouble can find you or you find trouble. With residences both in Manhattan and Brooklyn, any criminal activities that occur will result in an NYPD investigation or arrest and a subsequent prosecution by either the Manhattan District Attorney’s Office or the Brooklyn District Attorney’s Office. While this does not change the type of crime you may face or whether there will be a separate disciplinary hearing where the school seeks your suspension or expulsion, the offices are different and may have different policies in how they treat similar crimes in their respective jurisdictions.

Staying with criminal allegations, crimes committed or accusation of crimes at NYU, the nature of the offenses are no different than those committed by bankers, lawyers, marketers, bartenders or any other visitor, resident or worker in the City of New York. While some may be more prevalent, neither the Penal Law charges nor potential sentences change. For example, if you have a fake identification because you want to drink at a bar, no matter where it occurs the crime is a felony Second Degree Criminal Possession of a Forged Instrument. Prosecutors would have the right or ability to charge you with a Third Degree Criminal Possession of a Forged Instrument misdemeanor, but it is still a crime. Whether you damage someone’s property, steal from their room, slap them in the face, or just feel like smoking some weed, aka, marijuana (yes, that too), you can be prosecuted and find yourself arrested and given a Desk Appearance Ticket or brought down to the tombs where you may spend up to 24 hours in custody waiting to see a judge with every other person arrested in New York City anxiously waiting with you.

While not a completely inclusive list of crimes that you might face, the following are some of the more typical offenses prosecuted in New York City and ones that students at NYU can easily find themselves facing.

Whatever the charge, arrest, investigation or indictment, remember that you have rights. One of the most important ones is the right to remain silent. If you say something to an NYU administrator or police officer, that admission – even an apology – can be used against you. Think before you speak or at least consider immediately reaching out to a criminal defense lawyer or attorney. Depending on the evidence and crime, not only will your college days come to an abrupt end, but you are exposed to incarceration and a lifelong criminal record.

Disciplinary Hearings, Title IX and Expulsion from College

You haven’t been arrested? Free and clear of any consequences of wrongdoing? The one word answer is a resounding “no.” Whether or not you have been charged with a crime, your actions of harassment and discrimination based on gender or sexuality can set into motion a Title IX investigation where the outcome could be as serious as suspension or expulsion from NYU. If you a foreign national bad will become worse because your status and F1 visa may come into question as a result.

Whether you are prosecuted by the District Attorney’s Office, investigated by NYU, facing a disciplinary hearing as a result of a Title IX violation, or a combination of these potentially devastating activities, be smart, proactive and prepared. You have come too far to throw it all away. Contact the New York criminal lawyers and former Manhattan prosecutors at Saland Law and let experience, knowledge and advocacy be your strongest defense.
